DHS issues final rule changing admission period for foreign students and exchange visitors

The U.S. Department of Homeland Security (DHS) has issued a final rule to replace the long-standing “Duration of Status” (D/S) framework with a fixed period of admission for certain nonimmigrant visa holders in the F, J, and I classifications. The rule is intended to increase federal oversight, strengthen screening procedures, and address concerns related to visa compliance and fraud.

What will change for f-1 and j-1 visa holders?

Under the new framework, F-1 students and J-1 exchange visitors would generally be admitted for the length of their specific program, up to a maximum of four years. Individuals who need additional time would generally need to apply for an Extension of Stay (EOS) with USCIS.

The final rule also introduces several other changes:

• Fixed admission period: F-1 and J-1 holders would receive a specific authorized period rather than admission for Duration of Status.
• Extension of Stay: Those who need additional time may need to apply through USCIS and undergo additional federal review.
• Shorter grace period: The departure period for certain F-1 and J-1 nonimmigrants would be reduced to 30 days.
• Restrictions on program changes: The rule places additional requirements on certain changes involving academic programs and educational levels.

The rule was published in the Federal Register on July 17, 2026, with an effective date of September 15, 2026.

What should international students know?

The new framework would require F-1 and J-1 students to pay closer attention to their authorized admission period and maintain valid immigration status throughout their stay.

Students who need additional time to complete their programs or otherwise remain in the United States would need to follow the applicable extension or status procedures rather than relying on the previous Duration of Status framework.

Important update: On September 14, 2026, a federal court temporarily blocked DHS from implementing the final rule while the legal challenge proceeds. Therefore, the implementation of these changes is currently subject to the court proceedings.
